Description of Services

MNTowing provides towing and roadside assistance services. We offer towing services,

emergency towing, flatbed towing, long distance towing, and more. Our services are available to

customers in the Minneapolis/St.Paul metropolitan area. We reserve the right to refuse service

to anyone for any reason at any time.

Payment and Billing

Our rates may vary depending on the type of service you require. Payment is due at the time of

scheduling, and we accept CashApp, Venmo, and major credit cards. We do not offer credit

terms or invoicing. In the event that payment is not made at the time of service, we reserve the

right to charge a late fee or pursue legal action to collect payment, including but not limited to,

impounding your vehicle

GOA (Gone on arrival)

Gone on Arrival (GOA) means that a vehicle subject to a tow request has been moved prior to

Tow Contractor's arrival at the tow scene. We do not offer refunds on GOA regardless of the

reason the vehicle was GOA

Liability and Insurance

MNTowing.com is not responsible for any damage to your vehicle that occurs during towing or

transport. You assume all risk and liability for your vehicle while it is in our possession. We carry

liability insurance, but we are not responsible for any personal injury or property damage that

occurs during the towing process. You should ensure that your own insurance policy covers

towing and transport.

Indemnification

You agree to indemnify and hold MNTowing harmless from any claims, damages, or expenses

(including attorneys' fees) that arise from your use of our website or services, or from any

breach of these terms and conditions.

Disclaimer of Warranties

MNTowing makes no representations or warranties of any kind, express or implied, regarding

the operation of our website or services. We disclaim all warranties, including but not limited to

implied warranties of merchantability and fitness for a particular purpose. We do not warrant that

our website or services will be uninterrupted or error-free.

Limitation of Liability

MNTowing’'s liability to you is limited to the amount you paid for our services. We are not liable

for any indirect, incidental, special, or consequential damages arising from your use of our

website or services.

Cancellation Policy

Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email,

mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to

confirmation in writing.

Confidentiality

Client records are regarded as confidential and therefore will not be divulged to any third party,

other than manufacturers or if legally required to do so to the appropriate authorities. Clients

have the right to request sight of, and copies of any and all Client Records we keep, on the

proviso that we are given reasonable notice of such a request. Clients are requested to retain

copies of any literature issued in relation to the provision of our services. Where appropriate, we

shall issue Client’s with appropriate written information, handouts or copies of records as part of

an agreed contract, for the benefit of both parties.

Changes to these Terms and Conditions

MNTowing reserves the right to modify these terms and conditions at any time. Any changes will

be effective immediately upon posting on our website. Your continued use of our website and

services after any such changes constitutes your acceptance of the new terms and conditions.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of

the State of Minnesota. Any dispute arising from or related to these terms and conditions shall

be subject to the exclusive jurisdiction of the courts of State of Minnesota.
